The terms of this agreement ("Terms of Use") govern the relationship between you and D.G. CEDARTREE PROJECT LTD, with its address at the Chr. Chatzipavlou, 195-197 2nd Floor Office 23 3038 Limassol, Cyprus.

("Company" or "Us" or "We") regarding your use of mobile application Tropical Forest: Match 3 Story and “Hollywood Moments” and related services (the “App”, “Application” and "Service", “Services”), including all information, text, graphics, software, and services, available for your use. By downloading this App from AppStore/Google Play or play it on website https://cedar.games and using it, you accept the following Terms of Use.

If you do NOT agree to all these Terms of Use, please do NOT use this App.

D.G. CEDARTREE PROJECT LTD is authorized to amend the Terms of Use at any time, with the amended Terms of Use effective as soon as they are posted on the relevant App section.

1. Eligibility

The Services are intended solely for persons who are 12 or older. Any access to or use of the Services by anyone under 12 is expressly prohibited. By accessing or using the Services you represent and warrant that you are 12 or older.

2. Description of the Services

Subject to your compliance with these Terms of use the Company grants you a right to access and use App and its content solely for your personal entertainment and non-commercial purposes. You have no right to assign the right granted in this section to any other person.

3. Rights and obligations of D.G. CEDARTREE PROJECT LTD

3.1. D.G. CEDARTREE PROJECT LTD shall provide Services of adequate quality.

3.2. D.G. CEDARTREE PROJECT LTD reserves the right to undertake any necessary actions that are compliant with current legislation to restrict or terminate access to the Application and related resources to persons violating the terms of the present Terms of use.

3.3. The Company has the right to manage Application at its sole discretion, including among other things to delete and/or change any data, information, intellectual property, placed in the App.

3.4. The Company may at its own discretion change and upgrade both basic version of the Application and in-game items, provided in accordance with Section 5 hereunder, for the improvement of technical characteristics.

4. Rights and Obligations of the User

4.1. You have the right to use the App for personal, non-commercial purposes.

4.2. You have the right to participate in contests, quizzes, promotion actions conducted by the Company in the manner prescribed by the terms of such competitions, quizzes, promotion actions.

4.3. You have the right to address questions/requests related to the acceptance and execution of these Terms of Use to the Company.

4.4. You agree to comply with these Terms of Use and timely read the new version of the Terms of Use and to fulfill other requirements of the Company related to the use of the Application.

4.5. You agree to respect the intellectual property rights referred to in Section hereof. You also guarantee that you will not infringe on the rights of third parties, including intellectual property rights, while using the Application.

4.6. If You do not agree with these Terms of use, You oblige to stop using the App.

4.7. You may not:

4.7.1. use the App in any way that can interfere with the normal functioning of the App;

4.7.2. use third-party software to modify the Application;

4.7.3. use automated programs to collect information or interact with the App in any other way;

4.7.4. modify or create any derivative works based on the Application or any of its elements (including audio-visual elements), including translation or localization of such elements;

4.7.5. copy the elements of the Application;

4.7.6. dismember Application and/or its elements into its component parts;

4.7.7. decompile, disassemble, or in any other way attempt to derive the source code of the Application software;

4.7.8. sell in-game currency or in-game items, user accounts, and/or access to user accounts to any party in exchange for real currency or items and/or services of monetary value.

5. Intellectual Property Rights

5.1. The App and related Services (including, but not limited to, any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-Services chat transcripts, character profile information, recordings of games played using the Services and server software) are protected by copyright, trademark, and other laws. All intellectual property rights to the Application as a whole and in its separate parts belong the Company, if not stated otherwise. The Company prohibits unauthorized use of the Application or its parts in whole or in part.

6. Payment for in-game currency and in-game items and refunds

6.1. The App provides includes virtual in-game currency, that can be purchased for real money and in turn used to purchase virtual in-game items. Please note that Company does not handle and is not responsible for handling transactions acquiring in-game Currency. All in-game transactions are handled by third-party e-commerce payment providers. By purchasing in-game currency, you are bound by and agree to the third-party payment providers’ Terms of Use.

6.2. Company has the right at any time to reduce or raise the price of the in-game items temporarily or indefinitely, as well as to offer new products, services or payment terms for a long or limited period.

6.3. In-game currency and in-game items are digital items only. Your right to use any in-game currency and in-game items are limited to a non-exclusive, non-transferable, non-sublicensable, revocable right to use such currency and items solely for your personal entertainment and non-commercial use and for no other purpose. Except for the limited rights described herein, you have no property interest or right or title in or to any such In-game currency and in-game items which remain the exclusive property of the Company.

6.4. If you decide to purchase in-game items currency and in-game you agree to the pricing and payment terms applicable to such fees and charges, as posted in the App.

7. Limitation of liability

7.1. You are responsible before the Company and third parties for failure to comply with the Terms of use.

7.2. You shall indemnify the Company and third parties for any losses incurred in connection with his/her actions, including, inter alia, breach of the Terms of use, infringement of the copyright or any other intellectual property rights.

7.3. The Company under no circumstances shall be held liable to the User or other third parties for any indirect, incidental, unintentional damage, including, in particular, lost data, damage to honor, dignity or business reputation, loss of profit, caused by the use of the App, its components and materials, the access to which was obtained through App resources, even if the Company has not notified on the possibility of such damages.

7.4. The Company is released from liability for complete or partial failure to fulfill its obligations if such failure is the result of force majeure, i.e. extraordinary and unavoidable circumstances, including riots, prohibitive actions of the authorities, natural disasters, fires, accidents and also due to failures in the telecommunications and energy networks, actions of malicious programs, as well as the malicious actions of third parties aimed at unauthorized access or disabling the software or hardware system.

7.5. The Company does not guarantee that the Application will satisfy user’s requirements and the quality of information, data, graphics and other materials posted in the App and/or related resources will meet the expectations of the User.

9. Miscellaneous

9.1. These Terms of use shall be governed by the law of the Republic of Cyprus and/or applicable international treaties and agreements.

9.2. If any provision of these Terms of use is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision hereof or the validity or enforceability in other jurisdictions of that or any other provision hereof.

9.3. These Terms of use come into effect from the date of its acceptance by the User by any means specified hereunder and shall be valid for the entire period of use of the Application.
